What Is an Article 43 Annual Lead Survey?

Under Article 43, child care programs that contain lead-based paint or paint of unknown content must complete an annual lead survey.

The survey documents:

  • A visual inspection of all interior painted surfaces

  • Areas used by or accessible to children

  • Any peeling, chipping, cracking, or deteriorated paint

This requirement applies to school-based child care programs and is designed to prevent lead exposure before it becomes a health risk.

 

Article 43 Lead Survey Requirements


Annual visual inspection of interior painted surfaces. Required for school-based child care programs. Repairs due within 30 days by EPA-certified contractors XRF testing may qualify programs as lead-free. 

Article 43 Compliance Requirements

To remain compliant with Article 43, programs must:

  • Complete an annual lead-based paint survey

  • Use the survey form provided or approved by the Health Department

  • Perform all required repairs within 30 days of the visual inspection
    (Repairs must be completed by an EPA-certified contractor)

  • Submit the completed survey to the Health Department

  • Maintain documentation of inspection results and corrective actions

Parent & Guardian Notification Requirement

Article 43 also requires programs to share lead-based paint survey results with parents and guardians of every enrolled child.

  • Notification must be sent within 30 days of submitting the survey to the Health Department

  • A model notice to families is provided by the Health Department to help programs meet this requirement

Lead-Free Exemption Through XRF Testing

School-based child care programs that can demonstrate they are free of lead-based paint through X-Ray Fluorescence (XRF) testing are not required to complete the annual lead survey.
